开设网络赌场犯罪案件法律适用问题研究

摘　　要：从近年开设赌场犯罪案件情况看,受互联网技术、跨境交流等要素影响,此类犯罪已逐渐成为网络赌博犯罪的主要类型。针对网络赌场外观形式日益碎片化、境外网络赌场行为组织特征愈加明显的形势,司法机关在继续保持严惩态势的同时,也面临着罪名适用界限不清、量刑逻辑不明、出罪机制操作性不强等问题,有必要进一步改进法律适用技术,从网络犯罪的特点出发,突出开设赌场罪对组织网络赌博行为的惩治作用,在定罪量刑上形成由轻到重、由主到次的逻辑顺序。在犯罪治理层面,一方面可根据开设网络赌场犯罪案件涉案人员的特点,在有利于回归社会,减少社会对立面的层面,对具有从宽情节的特定人员适用相对不起诉,另一方面在相对不起诉与行政处罚相衔接时也要提高行政处罚的力度、广度,确保行为人罚当其过。According to the criminal cases of opening casinos in recent years,affected by Internet technology,cross-border exchanges and other factors,such crimes have gradually become the main type of online gambling crimes.In response to the increasingly fragmented appearance of online casinos and the increasingly obvious organizational characteristics of overseas online gambling behavior,the judicial authorities continue to maintain a strict punishment situation,but also face problems such as unclear boundaries of charges,unclear sentencing logic,and weak operability of the criminal mechanism.It is necessary to further improve the legal application technology,starting from the characteristics of cybercrime,highlight the punitive effect of the crime of opening a casino on organizing online gambling behavior,and form a logical order from light to heavy and from primary to secondary in conviction and sentencing.At the level of crime governance,on the one hand,based on the characteristics of the individuals involved in online casino crime cases,specific individuals with lenient circumstances can be subject to relative non prosecution in order to facilitate their return to society and reduce social opposition.On the other hand,when linking relative non prosecution with administrative penalties,the intensity and breadth of administrative penalties should also be increased to ensure that the perpetrator is punished appropriately.
