摘 要:商标权用尽的本质是避免商标权障碍经商标权人同意投放市场商品的流通,由此决定其适用条件是商品首次销售经过商标权人同意,这必然要求再次流通的商品与首次销售的商品相比,没有发生导致消费者误认的“人为主动干预”的品质改变。为此,不改变商品品质的重新包装,应认定为构成商标权用尽;无法确定是否会影响商品品质的重新包装,在充分披露重新包装信息的前提下,也应认定构成商标权用尽。The essence of trademark exhaustion is to avoid obstacles to the circulation of goods placed on the market with the consent of the trademark owner,which determines that the condition for its application is that the first sale of the goods has been made with the consent of the trademark owner,which necessarily requires that the goods that are recirculated have not undergone any"human-initiated intervention"that would lead to misrecognition by the consumers,as compared to the goods that were sold for the first time.This necessarily requires that the re-circulation of the goods has not changed the quality of the goods in comparison with the goods sold for the first time in a way that would lead to misrecognition.For this reason,repackaging that does not change the quality of the goods should be recognized as constituting exhaustion of trademark rights,and repackaging that does not affect the quality of the goods should also be recognized as constituting exhaustion of trademark rights,provided that full disclosure of the repackaging information is made.
