摘　　要：随着二手市场的发展与互联网的普及产生碰撞,可分为C2C模式和C2B2C模式的二手网络交易出现了一系列的问题。一方面,在这种法律关系下,需要确定认定经营行为的标准以及规范保证金条款,同时也要进行一定的商法与民法的交叉适用;另一方面,通过对博弈论视角下C2C模式与C2B2C模式的比较,并构造重复博弈的触发策略,来给买方与平台一些具体的建议。With the development of the second-hand market and the popularity of the Internet to produce col⁃lision,can be divided into C2C mode and C2B2C mode of second-hand network transactions have emerged a series of problems.On the one hand,under this legal relationship,it is necessary to determine the criteria for identifying business practices as well as regulating the margin clause,and also to carry out certain crossapplication of commercial law and civil law;on the other hand,a comparison of C2C model and C2B2C model un⁃der the perspective of game theory can be carried out,and the trigger strategy of repeated game can be con⁃structed to give some specific suggestions to buyers and platforms.
