“断卡”线索的侦办困境及对策研究

摘　　要：自全国“断卡”行动开展以来,各地公安机关向非法开办、贩卖电话卡和银行卡等违法犯罪行为发起凌厉攻势,从源头上遏制电信网络诈骗犯罪的高发态势。但是,全国每日“断卡”线索数量仍处于较高水平,在侦办“断卡”线索时,侦办成本高、涉案金额不够刑事打处标准、警银联动不顺畅以及冻结资金处置困难等问题已经成为各地公安机关普遍面临的侦办难题,严重影响了“断卡”线索侦办的质效。故应从公安机关实际侦办“断卡”线索的困境出发,进一步加大对涉案账户资金流水特征、“两卡”人员打处适用罪名、涉案人员行为特点的梳理分析力度,把握线索侦办的关键环节,提出强化内部协同作战以降低侦办成本、完善打处标准综合判定、加强单位间联席联动、构建特殊冻结资金处置机制等对策,以期能够应对“断卡”线索的侦办困境,提高侦办效能,解决基层公安机关实际工作中的侦办难题。Since the launch of the national“broken card”action,public security organs around the country have launched a fierce offensive against criminal activities such as illegally opening and selling phone cards and bank cards,curbing the high incidence of telecom network fraud crimes from the source.However,the number of“broken card”clues in the country are still at a high level.In the investigation of“broken card”clues,the investigation cost is high,the amount involved is not enough to meet the criminal standards,the linkage between the police and the bank is not smooth,and the disposal of frozen funds is difficult,which has become a common problem faced by public security organs around the country,seriously affecting the quality and efficiency of the investigation of clues.Therefore,we should start from the predicament of the public security organs in the actual investigation of“broken card”clues,further increase the analysis of the fund flow characteristics of the involved account,the applicable charges of the“two cards”personnel,and the behavioral characteristics of the involved personnel,so as to grasp the key links of the investigation of clues.Countermeasures such as strengthening internal coordination to reduce investigation costs,improving the comprehensive judgment of the standards,strengthening the joint linkage between units,and improving the disposal mechanism of special frozen funds are proposed,so as to cope with the investigation dilemma of“broken card”clues,improve the investigation efficiency,and solve the investigation problems in the actual work of grass-roots public security organs.
