放权改革中基层政府事权承接的问题与化解——以深圳“强区放权”改革为例

摘　　要：在放权改革中,基层政府“接不住”事权、“用不好”事权的问题比较突出。基于已有研究成果,将权力下沉过程中的“接权”与“用权”相衔接起来并置于政府执行力框架下,关注权力下放的内容特殊性与形式一般性,更有利于充分考察权力位移与运行的全过程,进而识别放权改革中的突出问题。深圳市“强区放权”改革实践中,机构争议、资源掣肘、财力支持不足以及办事效率有待提高、办事能力有待加强、法律风险有待化解等基层政府“接不住”“用不好”事权的问题凸显。究其原因,价值与行为冲突、统筹与应对能力不足、事权承接能力评估等机制缺失、对权力的公共性与事权动态位移的客观性认识不足、法律保障不充分等问题影响着事权承接过程。基于此,要以利益调整为出发点协调政府间事权关系、以能力强化为切入点提高事权承接效率、以机制构建为联动点优化事权运行流程、以行政文化建设为着力点塑造行政人格、以法律运行为立足点增强事权配置规范性等,保证事权承接的有效性。In the process of decentralisation reform,the problems of“not being able to undertake”and“not being able to use”the authority of the grassroots governments have become more prominent.In view of the existing research results,it is more conducive to examine the whole process of power displacement and operation by linking“undertaking”and“using”of authority in the process of decentralisation and placing it in the framework of government executive power,paying attention to the specificity of content and generality of form of decentralisation.It is more conducive to fully examining the whole process of power displacement and operation,and thus identifying the outstanding problems in the reform of decentralisation.In the practice of Shenzhen's reform of“power devolution of the strong district”,the problems of the grassroots government's“not being able to undertake”and“not being able to use”of its authority have been highlighted,such as disputes over organisations,constraints on resources,insufficient financial support,as well as problems of the need to improve efficiency,enhance competence,and resolve legal risks.The reasons for this are conflicting values and behaviours,insufficient coordination and response capacity,the absence of mechanisms for assessing the capacity to undertake authority,insufficient understanding of the public nature of authority and the objectivity of the dynamics of authority,and insufficient legal protection,which affect the process of undertaking authority.Based on this,it is necessary to coordinate the inter-governmental authority relations with interest adjustment as the starting point,improve the efficiency of authority transfer with capacity strengthening as the entry point,optimise the operation process of authority transfer with mechanism construction as the linkage point,shape the administrative personality with administrative culture construction as the focus point,and strengthen the normative nature of authority allocation with the operation of law as the f
