摘 要:当前我国退休返聘人员不具备《中华人民共和国劳动法》规定的劳动者地位,他们在劳动中的权利也缺乏劳动法的特别保护。保障退休返聘人员的劳动权利,是构建公正、和谐劳动关系的需要,是保障公民劳动权的要求,是鼓励退休人员发挥“余热”的有效措施,也是应对人口老龄化的迫切需要。因此,需要在立法上认可退休返聘人员的劳动者地位,并为他们在劳动中的权利提供平等保护,同时还要针对退休返聘人员的年龄和身体状态,为其提供特殊保障。Currently,the retired reemployed personnel in our country do not have the status of workers in labor law,and their rights at work are not subject to special protection by labor laws.Protecting the labor rights of retired reemployed personnel is not only the need to build a fair and harmonious labor relationship and the constitutional requirement to safeguard the basic rights of citizens,but also the effective measures to encourage retirees to use their“remaining heat”and to cope with the aging of the population.Therefore,legislation must recognize the status of retired reemployed workers as workers and provide equal protection for their rights in labor.At the same time,special protection must be provided for retired re-employed personnel based on their age and physical condition.
