数字平台反垄断监管第三方主体的引入机制

摘　　要：数字平台反垄断正处于由包容审慎的监管立场向常态化、精准化、科学化监管模式转变的过程中,监管技术在其中起到中流砥柱的保障、助推作用。现今的反垄断监管趋于疲软的重要原因在于监管队伍的专业认知能力较弱、技术水平较低,而大力发展数字经济的目标导向需要高水平的监管,才能确保反垄断监管合法、有力的发展。第三方主体在公平竞争审查评估实践中展现出了独立客观、专业科学的主体优势,引入数字平台反垄断领域具备适用理性。在机制建构中,应科学定位第三方主体的制度性地位,设置监管机关与第三方主体的科学协作机制,确保第三方主体的监管独立性。此外,亦需引导数字平台自觉配合接受监督。The anti-monopoly of digital platforms is in the process of progressing from an inclusive and prudent supervisory stance to a normalized,precise,and scientific regulatory model,and supervisory technology plays a pivotal role in protecting and promoting it.The main reason for the current slack anti-monopoly supervision is the weak professional cognitive ability and lower technical level of the supervisory team.The goal orientation of vigorously developing the digital economy requires high-level supervisory activities to ensure that anti-monopoly supervision is legal,effective,and conducive to development.The third party have demonstrated independent,objective,and professional advantages in the practice of fair competition review and evaluation,and the introduction of digital platforms in the field of antitrust has practical rationality.In the construction of the institution,the institutional status of the third party should be scientifically positioned,a scientific cooperation mechanism between supervisory authorities and the third party should be established,and it should ensure the supervisory independence of the third party.In addition,it is also necessary to promote digital platforms to consciously cooperate with supervision consciously.
