摘　　要：面向未来的人工智能技术严重威胁人类社会安全与福祉,具有人类社会务必整体防卫的重大性质,引发了基于自然政治的人工智能刑事法律风险的未来性质问题。根据类人属性和通用性质的变化,可以将面向未来的人工智能刑事法律风险划分为弱人工智能工具刑事法律风险和强人工智能“奇点变数”刑事法律风险。结合人工智能刑事法律风险防卫的信息刑法界面,形成了面向未来的人工智能刑事法律风险治理的理念和方法,包括人类的人工智能刑事法律风险治理理念、弱人工智能刑事法律风险协同治理和强人工智能刑事法律风险跨界治理的方法体系等。总的来说,就是要从“人是自然界的一部分”的理念出发,在人工智能刑法未来性质及其刑事法律风险防卫的根本任务的基础上,通过包括人类的人工智能刑事法律风险治理消除人机对立的因素,以奇点政治理性消解人工智能反控人类社会的重大危机。Future-oriented artificial intelligence technology seriously threatens the security and well-being of human society, and is of such a significant nature for the overall defense of human society, which has raised the future nature of the criminal legal risk of artificial intelligence based on natural politics. According to the changes in humanoid attributes and general nature, future-oriented artificial intelligence criminal legal risks can be divided into criminal legal risks of artificial intelligence tools and artificial general intelligence criminal legal risks. Combined with the information criminal law interface of artificial intelligence criminal legal risk defense, the ideas and methods of future-oriented artificial intelligence criminal legal risk governance have been formed: firstly, it includes the concept of human artificial intelligence criminal legal risk governance;secondly, it also includes weak artificial intelligence criminal legal risk collaborative governance and strong artificial intelligence criminal legal risk methodological system of cross-disciplinary governance. In general, it is necessary to start from the ideas of “human beings are a part of nature”, on the basis of the future nature of artificial intelligence criminal law and its criminal legal risk defense, to correct the human-AI adversarial relationship through artificial intelligence criminal legal risk governance including human beings, and defend against the risk of counter-controlled by artificial intelligence.
