摘  要:1998年前后,中国ISDS机制从传统保守模式向现代化自由模式转变。2012年前后,为平衡东道国自由监管权与投资者投资利益保护需求,中国转变为平衡模式的ISDS机制。受逐年增加的涉及中国的投资仲裁案件影响,中国在新平衡模式的ISDS机制中审慎细化了相关条约文本,划定了投资仲裁的范围,排除了最惠国待遇条款的运用,并增加了投资仲裁管辖时效的限制。为解决现行ISDS体系的缺陷,中国应当与外国谈判更新旧版ISDS机制的同时,增加仲裁前的投资机制与仲裁后的上诉机制,并拓展中国特色的“调解+仲裁”模式的运用。Around 1998,China changed its ISDS mechanism from the conservative model to a modern and liberalized one.To re-balance between the need of regulating foreign investment by host states and the need to protect their investments by foreign investors,China has formulated a balanced ISDS mechanism.Taking into account the increasing number of investment arbitration and the award in its balanced ISDS mechanism,China has drafted its IA clauses cautiously,which redefines the scope of the jurisdiction of arbitral tribunals,limits the scope of the application of MFN clauses on the ISDS mechanism and adds limitation of action.To address the drawbacks of current Chinese ISDS system,China has to negotiate with other states to update its ISDS mechanism,add complaint settling system as well as appealing system and expand the application of the"mediation+arbitration"model to ISDS mechanism.
