摘　　要：数据的要素本质明确后,数据价值在商事活动中得到了充分的肯定与实现。然而,经利益导向的驱使,数据侵权行为在企业经营与数据交易中频发。且企业数据财产权益虽得到司法肯认,但相关规范路径针对性较弱,无法有效满足企业数据权益的保障需求。应通过追溯企业数据侵权责任的起源,明确对归责路径的选择与具体要件的设定,从而连接数据侵权行为的责任认定链条,为企业数据财产侵权行为规范的完善提供一定的参考与理论支撑。Since the essence of data elements has been clarified,the value of data has been fully affirmed and realized in commercial activities.However,driven by profit-oriented,data infringement occurs frequently in enterprise operations and data transactions.In addition,although the rights and interests of enterprise data property have been recognized by the judiciary,the relevant regulatory path is weakly targeted,and cannot effectively meet the protection needs of enterprise data rights and interests.It is necessary to trace the origin of enterprise data infringement liability,clarify the selection of the attribution path and the adjustment of specific elements,so as to connect the chain of liability determination of data infringement and provide certain reference and theoretical support for the improvement of enterprise data property infringement norms.
