摘 要:为适应政策和实际需要,老旧小区加装电梯正在各地推进中,期间矛盾纠纷不断。基于对公共利益的保护,法院倾向判决遭受不利影响的一方承担一定的容忍义务,但适用限度仍不够明确。容忍义务作为对所有权的限制,具有权利冲突的本质,在电梯加装中具有重要意义。对于容忍义务的适用,立法不明确且主观性强,司法裁判中法官也会以过错判断、实际损害、利益衡量作为判断容忍义务限度的依据。对此,应将实质性损害标准作为首要因素,以人身权益兜底,并设置人身权益优先的排除规则,以利益衡量为补充,审慎适用公共利益作为裁判理由。In order to adapt to policy and actual needs,the installation of elevators in old residential communities is being promoted in various places,during which conflicts and disputes continue to arise.Based on the protection of public interests,courts tend to rule that the party suffering adverse effects should bear certain tolerance obligations,but the scope of application is still not clear.The tolerance obligations,as a limitation on ownership rights,has the essence of rights conflicts,and has significant implications in the installation of elevators.The application of tolerance obligations is not clear in legislation and subjective,and judges will also use fault judgment,actual damage,and interest measurement as the basis for judging the limits of tolerance obligations in judicial rulings.In this regard,the substantive harm standard should be taken as the primary factor,with personal rights and interests as the fallback,and an exclusionary rule that gives priority to personal rights and interests should be set,with interest measurement as a supplement,and the judicial rulings should be exercised with caution based on the principle of public interest.
