浅析酌定不起诉制度

摘　　要：酌定不起诉,指的是在犯罪中,人民检察院可以做出不起诉的决定,做出这一决定的前提是犯罪嫌疑人所犯之罪情节轻微,并且依照法律规定不需要判处刑罚或者免除刑罚。在长期的司法实践中,酌定不起诉的适用上出现了一些突出的问题,如公诉机关内部的审批和报请程序复杂麻烦等,导致酌定不起诉制度的成立之初提高诉讼效率的目的并未得到初步的实现。因此,笔者希望能够通过对我国酌定不起诉制度的含义、内容、意义等方面进行全面分析,论述酌定不起诉的基本理论和实施方式;其次,对现如今酌定不起诉制度在立法层面和司法实践的现状进行分析,讨论其中存在的问题;最后针对我国酌定不起诉制度在法律规定和司法实践中存在的问题,提出个人的建议,以期达到完善的目的。Discretionary non-prosecution means that in a crime,the People’s Procuratorate may make a deci-sion not to prosecute.This decision is based on the premise that the circumstances of the crime committed by the suspect are minor,and in accordance with the law does not need to impose a pen-alty or exemption from punishment.In the long-term judicial practice,there have been some prom-inent problems in the application of discretionary non-prosecution,such as the complicated and troublesome procedures for examination and approval and application within the public prosecution organs,which has hindered the initial goal of enhancing litigation efficiency that the discretionary nonprosecution system aimed to achieve.Therefore,the author hopes to analyze the meaning,con-tent and significance of China’s discretionary non-prosecution system,and discuss the basic theory and implementation of discretionary non-prosecution.Secondly,this paper analyzes the current situation of the system of discretionary non-prosecution at the legislative level and in judicial practice and discusses the existing problems.Finally,the author will provide personal recommendations addressing the problems within China’s discretionary non-prosecution system in terms of le-gal provisions and judicial practices,with the aim of achieving improvement.
