摘　　要：现行司法实践对于受虐妇女合法权益保护作用有限,受虐妇女杀夫案件普遍存在受虐妇女综合征无法适用现行阻却事由体系以及部分案件量刑过重、同案不同判等问题。我国可参考国外对于受虐妇女综合征在定罪量刑中的作用,并与我国司法实际情况与正当防卫、刑事被害人的过错等抗辩事实进行结合,在司法程序上通过司法鉴定允许专家辅助人出庭发表意见。可以根据我国司法实际情况,促进防卫行为规定与受虐妇女综合征结合、推进受虐妇女综合征与被害人过错抗辩事由结合等方式为受虐妇女寻求刑事责任减免空间。或者能够新设受虐妇女综合征作为单独的责任阻却事由条款,通过完善举证制度最终达到促进受虐妇女综合征这一概念在我国司法实践中予以适用的结果。The current judicial practice has limited protection for the legitimate rights and interests of abused women,and cases of abusive women killing their husbands generally have problems such as the inability to apply the current system of reasons for obstruction,excessive sentencing in some cases,and different judgments in the same case.Therefore,China can refer to foreign countries for the role of abused women’s syndrome in criminal sentencing,and organically combine it with the actual judicial situation in China and the defense facts such as self-defense and the fault of criminal victims.In the judicial process,experts are allowed to assist in giving opinions in court through judicial ap-praisal.According to the actual judicial situation in our country,we can promote the combination of defense behavior regulations and abused women’s syndrome,and promote the combination of abused women’s syndrome and victim’s fault defense reasons to seek criminal liability reduction space for abused women.Alternatively,we can establish a new clause on abused women’s syndrome as a separate reason for obstruction of responsibility and invite expert assistants to appear in court to assist in the investigation.
