检察机关提前介入监察调查的实践困境与完善路径

摘　　要：监检衔接作为国家监察体制改革深入推进的重要命题,其关键环节在于检察机关的提前介入。尽管检察提前介入的理论正当性尚存争议,但鉴于当下实践中的高介入率和广泛覆盖面,对其实践难题进行技术分析和对策探讨显得尤为迫切。本文旨在检视检察提前介入监察中存在的启动机制不完善、角色定位不明晰、结果反馈机制不健全等问题,并提出明确监察提前介入案件范围、规范介入时间、丰富启动方式、科学定位角色及完善反馈机制等建议,以期疏解实践难题,确保监检衔接的平稳运行与职务犯罪调查合力的有效凝聚。同时,呼吁未来在检察提前介入监察制度层面进行顶层设计,进一步探讨和完善检察提前介入监察的理论基础。As an important proposition to further promote the reform of the national supervision system,the key link lies in the early intervention of procuratorial organs.Although the theoretical legitimacy of early intervention is still controversial,in view of the high intervention rate and wide coverage in current practice,it is particularly urgent to carry out technical analysis and countermeasures to its practical problems.This paper aims to examine the problems existing in the early intervention supervision of procurators,such as the imperfect starting mechanism,unclear role positioning,and imperfect result feedback mechanism,and put forward suggestions such as clarifying the scope of early intervention cases,standardizing the intervention time,enriching the starting method,scien-tifically positioning the role,and improving the feedback mechanism,so as to resolve practical problems.To ensure the smooth operation of supervision and inspection connection and the effec-tive cohesion of investigation of duty crime.At the same time,it calls for top-level design at the level of supervision system of early intervention of procurators in the future,and further discusses and improves the theoretical basis of early intervention of procurators in supervision.
