试论环境侵权案件下的责任构造与救济机制

摘　　要：党的二十大召开以来,党中央顺应时代发展和人民期盼,高度重视法治在治国理政中的重要地位,更加注重发挥司法在生态文明建设中的重要作用。本文拟以环境侵权案件为出发点,结合博弈论的观点厘清环境侵权案件中的举证责任与因果关系构造;同时对环境侵权案件中的法理与实务操作进行检视,结合政府规制、替代性补偿、企业合规等视角,为环境侵权的损害后果提出可行的救济路径。Since the 20th CPC National Congress,to meet the needs of the times and people's expectations,the CPC Central Committee has attached great importance to the position of the rule of law in the governance of the country and paid more attention to the role of the judiciary in the construction of ecological civilization.In this context,this paper aims to elucidate the burden of proof and causal relationship building in environmental tort cases based on the viewpoint of game theory.Besides,it reviewed the legal theory and practical operation of environmental tort cases,and put forward feasible remedy paths for the damage of environmental infringements from the perspectives of government regulation,alternative compensation and corporate compliance.
