摘 要:随着我国刑事犯罪结构的显著变化,轻罪案件大幅增多,轻罪治理不仅是犯罪治理科学化的必然要求,更是国家治理现代化的必然要求。在刑事一体化框架内,基于轻罪多元化成因,检察机关通过构建系统化的轻罪案件分案规则,创新性地提出“一站式”轻罪工作体系,强化行刑衔接的闭环治理模式,并通过检察建议推动轻罪源头治理,有效承担起轻罪“治罪”与“治理”双重职能,为“轻罪时代”社会治理转型释放检察之智。With the significant changes in the criminal structure of China,misdemeanor cases have increased significantly.The governance of misdemeanors is not only an inevitable requirement for scientific crime management,but also an inevitable requirement for the modernization of national governance.Within the framework of criminal integration and based on the diversified causes of misdemeanors,the procuratorial organs have innovatively proposed a“one-stop”misdemeanor work system by constructing systematic classification rules for misdemeanor cases and strengthened the closed-loop governance model of administrative and criminal connection.It also promotes the governance of the source of misdemeanors through procuratorial recommendations,effectively assumes the dual functions of“punishment”and“governance”of misdemeanors,and releases procuratorial wisdom for the transformation of social governance in the“misdemeanor era”.
