摘　　要：举报制度具有弥补信息不对称的法律价值,所以在道路交通安全执法领域得到广泛应用。举报功能的实现依托于受理、核实、查处、反馈的制度运行过程,其有助于增强执法的精准性与预防性,促进举报型交警执法新模式的形成。但与此同时,兼具价值性与风险性的举报行为由于受体系性规则欠缺等因素影响,面临着从“参与性”转向“职业化”、“合作”异化为“冲突”的法治隐忧。为确保道路交通违法行为举报制度效能的实现,有必要在“保障论”与“界限论”的指导下明晰其法律定位,推动以专门立法为指引、执法部门参与引导、司法理性化解冲突的法治化建设。The whistleblowing system has legal value in compensating for information asymmetry,so it is widely used in the field of road traffic safety law enforcement.The realization of the whistleblowing function relies on the system operation process of acceptance,verification,investigation,and feedback,which helps to enhance the accuracy and preventability of law enforcement,and promotes the formation of a new whistleblowing-type traffic police law enforcement model.However,at the same time,due to the lack of systematic rules and other factors,the whistleblowing behavior that combines value and risk which is facing the hidden worries about the rule of law from"participation"to"professionalization"and"cooperation"to"conflict".In order to ensure the effectiveness of the road traffic violation whistleblowing system,it is necessary to clarify its legal positioning under the guidance of"Guarantee Theory"and"Boundary Theory",promote the legalization construction with the specific legislation as a guide,the participation and guidance of law enforcement departments,and the reasonable resolution of flicts through judicial means.
