摘 要:在网络不正当竞争案件中,商业道德易成为法院判断竞争行为正当性的依据。而商业道德作为相对抽象的概念,需经阐释才能妥善适用。现有阐释路径可大致分为直接路径与间接路径两种,即依据行业公约等渊源的路径和司法创设的路径,二者都存在互联网经济竞争秩序下的适用障碍。商业道德产生于市场主体的互动,是对行业内竞争现实的反映。商业道德本应发挥将竞争现实输入竞争规则的作用,商业道德阐释也应立足于此。网络不正当竞争案件需要通过商业道德这一渠道将互联网经济的新业态、新趋势输入竞争规则之中,让竞争行为正当性判断服务于行为规制的任务,维护互联网经济的创新空间和活力。concept needs to be explained to be properly applied.The existing interpretation paths of business ethics can be roughly divided into direct path and indirect path,both of which have certain application barriers and fail to match the competitive order of the Internet economy.Business ethics arises from the interaction of market entities and reflects the reality of competition within the Internet economy.Business ethics should have played a role in inputting competition reality into competition rules,and the interpretation of business ethics should also be based on this.Internet unfair competition cases need to input the new business forms and new trends of the Internet economy into the competition rules through the channel of business ethics,so that the judgment of the legitimacy of competitive behavior can serve the task of behavior regulation,and maintain the innovation space and vitality of the Internet economy.
