摘 要:为探讨劳动法典编纂其在完善劳动法治体系及中国式现代化中的地位与实现路径,文章分析了当前劳动法典编纂的基础条件,包括政治、文化、法律等方面,指出劳动法治体系是中国式现代化重要组成部分,编纂时机已成熟:党的领导提供政治基础,中华法系传统提供文化基础,现有法律体系及学界成果提供法律基础。在具备多方面基础条件下,提出要采取构建集成式法典编纂模式,以保护劳动者的合法权益为逻辑主线,各编依次为总则、劳动基准、劳动合同、特别劳动者、集体协商、劳动保障监察、劳动争议调解仲裁。To explore the status and implementation path of the compilation of the labor code in improving the labor legal system and Chinese-style modernization,the article analyzes the current basic conditions for the compilation of the labor code,including political,cultural,legal and other aspects.It is pointed out that the labor legal system is an important part of Chinese-style modernization,and the timing for compilation is ripe:the Party's leadership provides a political foundation,the traditional Chinese legal system provides a cultural foundation,and the existing legal system and academic achievements provide a legal foundation.Under the circumstance of having multiple basic conditions,it is proposed to adopt a construction of intergrated code compilation model and take the protection of the legitimate rights and interests of workers as the logical main line,and that the chapters are in turn the general provisions,labor benchmarks,labor contracts,special workers,collective consultations,labor security supervision,and labor dispute mediation and arbitration.
