摘　　要：在大数据时代,为回应数字社会司法治理中产生的新问题和新需求,司法理论需要立足数字社会法治秩序的基本规律,实现变革与发展。就司法权性质而言,司法具有大数据决策和自动化决策的特征,并成为国家规制数据公共风险的工具,这是对传统司法权被动性、程序性和中立性的调试;就法院功能而言,法院同时具备数据生产者、数据控制者和数据治理者身份,这使得纠纷解决、公共政策形成等传统法院功能在大数据时代得到深化和拓展;就司法裁判模式而言,大数据时代的法律适用和事实认定已不再完全以国家法和因果关系为中心,司法责任的分配逻辑也发生变化。迈向大数据时代的司法具有鲜明的风险化解导向,本质上是预防型法治在司法领域的演绎,体现了风险泛在背景下司法对安全价值的重视。In the era of big data,in order to respond to the new problems and new demands arising from judicial governance in the digital society,judicial theory needs to be based on the basic laws of the rule of law order in a digital society,and to realize innovation and development.As far as the nature of judicial power is concerned,justice has the characteristics of decision-making driven by big data and automatic decision-making,and it has become a tool for the state to regulate the public risk of data,which is an adjustment of the passivity,procedure rules and neutrality of traditional judicial power;as far as the court's functions are concerned,the court play the role of data producer,data controller and data administrator,which deepens and expands the traditional court functions such as dispute resolution and public policy formation in the era of big data;as far as the mode of judicial adjudication is concerned,the legal application and fact finding in the era of big data are no longer completely centered on national law and causality,and the distribution logic of judicial responsibility has also changed.Justice in the era of big data has a distinct risk resolution orientation,which is essentially the interpretation of the precautionary rule of law in the judicial field,reflecting the importance that justice attaches to the value of security in the context of ubiquitous risks.
