学位授予程序中不同审查主体的职责定位及其展开

摘　　要：明确学位授予程序中不同审查主体的职责定位及其相互关系,是规范学位授予行为、保障申请人获得公正评价权的核心问题。通过对《学位法》中学位授予程序条款及关联条文的规范分析,学位申请受理机构、评阅专家、答辩委员会、学位评定分委员会、学位评定委员会在学位授予程序中的职责定位分别是受理机构负责学位申请的形式审查,评阅专家和答辩委员会分阶负责学位论文的实质审查,学位评定委员会及其分委员会负责学术监督和学位评定。基于权力配置的功能适当原理,学位评定分委员会是合适的学位申请受理机构;评阅专家具有答辩资格建议权而非决定权;答辩委员会的性质是学位考试委员会,具有学位论文成绩评定权;学位评定分委员会应当行使学位授予权的大部分权能;学位评定委员会的统领作用应体现在作为学位授予程序监督者和学位授予争议裁决者的地位上。不同审查主体由此形成以学位评定委员会为中心,分段参与、协作治理的“一核多元”关系格局。The duties and interrelationships of different subjects in the degree-awarding process are the core issues to standardize degree awarding behavior and guarantee applicants′right to obtain fair evaluation.Through the normative analysis of the provisions of degree-awarding process in the Academic Degree Law,the duties of the accepting authority,the examiner,the defense committee,the degree sub-committee and the degree committee are as follows:the accepting authority is responsible for formal review;the examiner and the dissertation defence committee are responsible for the substantive examination of the dissertation;the degree evaluation committee and its sub-committees are responsible for academic supervision and degree evaluation.Based on the principle of functional appropriateness,the degree sub-committee is qualified authority to accept degree application;the examiner has the power to recommend the defense qualification rather than the power to decide;the nature of the defense committee is the degree examination committee,which has the power to judge the grade of the dissertation;the degree sub-committee shall exercise most of the power to confer degrees;the leading role of the degree evaluation committee should be reflected in its position as the overseer of the degree-awarding process and the adjudicator of degree awarding disputes.The different review subjects thus form a"one core,multiple subjects"relationship pattern centered on the degree evaluation committee,with segmented participation and collaborative governance.
