领域法学视域下农业农村立法完善

摘　　要：农业农村问题始终是关乎党和国家前途命运的根本性问题。随着农业农村现代化进程加快,农业农村面临新的形势与挑战,所产生的现实问题兼具复杂性与多元性,以部门法学为基石的农业农村法治体系难以有效应对。近年来领域法学的兴起与发展,给农业农村法治领域的困境破局带来曙光。尤其是农业农村立法的历史、现实与理论逻辑同领域法学特征深度契合,使领域法学成为农业农村立法的重要理论指引。领域法学以问题导向性、研究综合性、视角开放性为基本特征,指引着农业农村立法需要加强重点领域立法、完善滞后立法,平衡中央与地方法律位阶、注重政策与法律互动,强化动态调整立法理念,加快涉外立法构建,三者融合的最终旨趣是实现农业农村法的法典化,为农业农村现代化提供高效有力的法治保障体系。The issue of agriculture and rural areas has always been fundamental to the future of the Party and the country.As the modernization of agriculture and rural areas accelerates,these sectors face new circumstances and challenges.The resulting complexities and diversities pose significant difficulties for the rule of law system in agriculture and rural areas,which is primarily based on sectoral jurisprudence.Recently,the emergence and development of domain jurisprudence offer a glimmer of hope for addressing the challenges in agricultural and rural law.In particular,the historical,current,and theoretical logic of agricultural and rural legislation align closely with the characteristics of domain jurisprudence,making it an important theoretical guide for this field.Domain jurisprudence is defined by its problemoriented approach,comprehensive research and open perspective.It emphasizes the need for agricultural and rural legislation to strengthen the key areas of legislation,improve outdated laws,balance the legal standing of central and local authorities,focus on the interaction between policy and law,strengthen the concept of dynamic adjustment of legislation,and accelerate the construction of foreign-related legislation.The ultimate goal of integrating these efforts is to achieve the codification of agricultural and rural laws,providing a robust and efficient rule of law system for the modernization of agriculture and rural areas.
