叙事学理论视角下的法官庭审修辞研究

摘　　要：探讨叙事学理论视角下的法官庭审修辞研究,实则探讨两个问题的合流:一是让法官庭审的叙事问题回归叙事学本身;二是探讨叙事学理论对法官庭审修辞研究的补充。基于此,以后经典叙事学中最为重要的流派之一修辞性叙事学为讨论对象,对法官庭审叙事研究的理论工具予以重新审视,并梳理将修辞性叙事学纳入法官庭审修辞研究的理论基础。此外,以修辞性叙事学关注的重要问题“叙事交流模式”和“不可靠叙述”为例,探索将叙事学中的经典模式与概念应用于法官庭审叙事修辞研究的路径,并以“刘慧苗案”为例予以实践。尝试将修辞性叙事学理论纳入到对法官庭审叙事修辞的研究中,不仅拓展了法官庭审修辞研究的讨论空间,也为叙事学与法学的交叉研究做出了新的探索。The study of judicial rhetoric in court trials from the perspective of narrative theory is in fact a merging of two issues:one is to bring the narrative issue of judicial trials back to narratology itself;the other is to explore how narrative theory can supplement the study of judicial rhetoric.Starting from this point,this article focuses on one of the most important schools in post-classical narratology,rhetorical narratology.It first re-examines the theoretical tools for the study of judicial trial narratives and outlines the theoretical basis for incorporating rhetorical narrative theory into the study of judicial rhetoric.The article then takes "narrative communication mode"and"unreliable narration",which are important issues in rhetorical narratology,as an example,to explore the path of applying classical modes and concepts in narratology to the study of judicial rhetoric in court trials,and takes the case of"Liu Huimiao"as an illustration.This article attempts to incorporate the theory of rhetorical narratology into the study of judicial rhetoric in court trials,which not only expands the study of judicial rhetoric in court trials,but also makes a new exploration of the cross-study between narratology and the law.
