摘　　要：随着国家城市化的进一步推进及私有汽车总量的逐年增加,居民对于停车位的需求以及经营性停车场的接受度也随之增长,这给专业停车场管理公司(以下简称“停车管理公司”或“公司”)带来了巨大的发展机遇。但由于停车场经营行业本身的多样性及合作方的不可预测性,停车场管理公司在经营过程中,遭遇了不同程度的各类法务风险,给公司带来了诸多经营问题及发展阻碍。文章充分调研JT公司在北京乃至全国范围内的经营性停车场项目前期获取及后续运营过程中,不同经营权获取模式下、不同业态中存在的法务风险,总结经验教训,探索出可供借鉴的法务风险防控方法。With the further advancement of national urbanization and the annual increase of the total number of private cars,residents’demands for parking spaces and the acceptance of commercial parking lots have been also growing,which bring great development opportunities for professional parking lot management companies(hereinaf⁃ter referred to as“parking management companies”or“companies”).However,due to the diversity of the park⁃ing lot industry itself and the unpredictability of the partners,the parking lot management companies has encoun⁃tered various legal risks to varying degrees in the process of the parking lot operation,which has brought many busi⁃ness problems and development obstacles to the company.This paper fully conducts surveys of the legal risks of JT company in different management right acquisition modes and different business formats in the early acquisition and subsequent operation process of commercial parking lot projects in Beijing and even across the whole country,sum⁃marizes the experience and lessons,and explores the legal risk prevention and control methods for reference.
