印度尼西亚等5个东盟国家对化学品的技术性贸易壁垒及应对建议

摘　　要：通过查询法律、法规及技术规范,解析了印度尼西亚、马来西亚、菲律宾、泰国和越南这5个东盟国家对化学品的监管要求。经研究发现,这5个国家均针对化学品管理颁布了专门的监管法规和技术规范,并要求按照《全球化学品统一分类和标签制度》对化学品进行分类、标签和编写安全数据单;马来西亚、菲律宾、泰国、越南已发布国家有害化学品列表;马来西亚的列表中包含统一的全球化学品统一分类和标签制度分类,泰国、越南将列表中的化学品按照危险特性进行分类管理。建议我国出口企业根据产品特性和目的国要求按照《全球化学品统一分类和标签制度》编写标签和安全数据单,各地海关部门应关注东盟国家对化学品的监管要求变化,以助我国出口企业破除技术性贸易壁垒。By consulting laws,regulations and technical specifications,the regulatory requirements for chemicals in five ASEAN countries,namely Indonesia,Malaysia,Philippines,Thailand and Vietnam,were analyzed.It was found that all countries have promulgated special regulatory regulations and technical specifications for chemical management.Chemicals should be classified and labeled in accordance with the Globally Harmonized System of Classification and Labeling of Chemicals(GHS) and the safety data sheet should comply with GHS;Malaysia,Philippines,Thailand and Vietnam have issued national lists of hazardous chemicals;Malaysia's list contains a unified GHS classification,and Thailand and Vietnam have classified and managed chemicals in the list according to their hazardous characteristics.It was recommended that export enterprises prepare labels and safety data sheets in accordance with GHS based on products' characteristics and destination country requirements.Customs departments should pay attention to regulatory requirements changes for chemicals in ASEAN countries and help Chinese export enterprises break down technical trade barriers.
