论法律人本主义视角下的正义感

摘　　要：正义感可以追溯到古希腊时期的血气、激情等概念。正义感提出对等报复的诉求,既反映人受到伤害后通过行动捍卫权利和尊严的勇气,也反映公众或集体在特定情境下有关正义或者应当的价值判断和期许。正义感是主体意志和权利的体现,通过司法场域的商谈和交流,个体性的正义感获得公共理性,正义感话语转化为法律话语。正义感是法律实现其自然目的的一个基本要素,一方面对主体参与法律活动、捍卫自己权利的行为提供价值上的支持和引导,另一方面在现代法律制度中具有明确的规范价值,并成为司法裁判的重要考量因素。The sense of justice can be traced back to the concepts of thymos and passion in ancient Greece.The sense of justice,linked to the desire for reciprocal revenge,reflects the courage of human beings to defend their rights and dignity through their actions and appeals after they have been harmed,it also reflects the value judgments and expectations of the public or the collective about justice or ought under certain circumstances.The sense of justice is the embodiment of the subject's will and right.Through the negotiation and communication in the judicial field,the individual'sense of justice obtains the public rationality,and the discourse of the sense of justice is transformed into the legal discourse.The sense of justice is an element of the rationality of law in achieving its natural purpose.On the one hand,the sense of justice provides value support and guidance for the subject to participate in legal activities and defend his rights.On the other hand,the sense of justice has a clear normative value in modern legal system,and become an important basis for judges to adjudicate cases.
