摘　　要：随着技术进步与时代更迭,人工智能参与学位论文创作已是不争的事实。在现行法律规范体系中,缺乏对人工智能参与学位论文创作进行规制的针对性法律表达。人工智能参与学位论文创作会诱发学术不端、侵害相关主体法定权利的多重风险,呼唤着立法革新方案的出台。技术性正当程序与敏捷治理的立法引入,是因应相关风险进而促成法律革新的有效路径。技术性正当程序强调提升算法与数据技术的透明度,尤其是赋予学位申请人以透明度履行义务,这将助益于学位申请人在理解算法与数据技术的基础上,规范使用人工智能,从而尽可能规避学术不端的现实风险;敏捷治理则重在构建法律的协同共治模式,从而以多元规范、多维手段的方式防范相关主体法定权利受到侵蚀的潜在风险。With the progress of technology and the change of times,it is an indisputable fact that artificial intelligence participates in the creation of academic dissertations.In the current legal norm system,there is a lack of targeted legal expression to regulate the participation of artificial intelligence in the creation of academic dissertations.The participation of artificial intelligence in the creation of academic dissertation will induce multiple risks of academic misconduct and infringement of the legal rights of relevant subjects,which calls for the introduction of legislative innovation programs.The introduction of legislation on technical due process and agile governance is an effective way to promote legal innovation in response to relevant risks.Technical due process emphasizes on improving the transparency of algorithms and data technology,especially giving degree applicants the obligation of transparency,which will help degree applicants to regulate the use of artificial intelligence on the basis of understanding algorithms and data technology,so as to avoid the real risk of academic misconduct as much as possible.Agile governance focuses on building a cooperative governance model of law,so as to prevent the potential risk of the erosion of the legal rights of relevant subjects by means of multiple norms and multi-dimensional means.
