摘 要:算法嵌入行政程序中,推动行政方式由传统的“人—人”互动式向数字化的“人—机”互动式演进,衍生出以自动化决策为外在表象、以算法驱动为内在基础的算法行政。这一系列变化导致行政法上的正当程序原则受到冲击,让相对人程序权利的实现面临困境。此类困境之成因,既源于算法技术本身固有的缺陷,亦因既有法律存在不足。为恢复行政程序中的价值理性,可以从宏观价值引导、中观立法跟进及微观主体约束三个层面进行深入探讨与实践。Algorithms have been embedded in administrative procedures,driving the evolution of administrative methods from the traditional“human-to-human”interaction to the digitized“human-to-machine”interaction,thereby giving rise to algorithmic administration,which is externally manifested as?automated decision-making and internally based on algorithmic driving.This series of changes has impacted the principle of due process in administrative law,posing difficulties for the realization of procedural rights of the counterparts.The causes of such dilemmas stem from the inherent defects of the algorithmic technology itself,as well as the deficiencies of the existing laws.To restore the value of rationality in administrative procedures,in-depth exploration and practice can be conducted at three levels:macro-value guidance,meso-legislation adaptation,and micro-subjective constraints.
