论《民法典》债务用于“夫妻共同生活”规则之解构

摘　　要：《民法典》确定了三种类型的夫妻共同债务,分别是基于夫妻共债共签形成的共同债务、基于家庭日常生活需要形成的共同债务、基于债务用于夫妻共同生活或共同生产经营形成的共同债务。其中,债务用于“夫妻共同生活”的性质、认定规则及清偿规则并不明确,同案不同判现象严重。因此,有必要从民事法律行为理论视角出发,认定债务用于“夫妻共同生活”的应然性质为连带债务,厘清债务用于“夫妻共同生活”的认定规则和清偿规则,包括清偿责任财产的范围和顺序,以平衡举债方配偶与婚姻关系外部债权人的利益。The Civil Code stipulates three types of joint debts of husband and wife,namely,the joint debt formed on the basis of joint signature of both parties,the joint debt arising from family daily life,and the joint debt formed on the basis that the debt is used for the mutual life or joint production and operation of husband and wife.Among them,the nature,identification rules,and repayment rules of debts used for the“mutual life of husband and wife”are not clear,resulting in serious phenomena of different verdicts for the same case.Therefore,it is necessary to proceed from the perspective of civil legal act theory to determine the ought-to-be nature and joint and several liability of debts used for the“mutual life of husband and wife”,and clarify the identification and repayment rules of debts used for the“mutual life of husband and wife”,including the scope and order of repayment liability property,in order to balance the interests between the spouse who has incurred the debt and the external creditors of the marital relationship.
