关于完善成片开发约束机制的思考与建议

摘　　要：新修订的《中华人民共和国土地管理法》提出的以“限制征收集体土地、缩小征地范围”为导向的成片开发政策引起社会热议,防范成片开发引发公共利益肆意扩张和土地征收泛化成为焦点。文章通过分析现有的政策约束机制,指出当前还存在国土空间规划体系尚未健全、“公益性”审查制度还不完善、缺乏完善的监督机制、权利人参与权保障不足等风险隐患。结合地方实践提出相关政策建议:以新发展理念指导成片开发,完善国土空间规划体系,从程序上规范公益性审查制度,强化事后监督和公众监督,完善被征地人参与机制。The whole plot development policy aroused heated social discussion,which is oriented by"restricting the collection of collective land and narrowing the scope of land expropriation"proposed by the newly revised Land Administration Law of the People's Republic of China.It became the focus to prevent the arbitrary expansion of public interests and the generalization of land expropriation caused by the whole plot development.By analyzing the existing policy constraint mechanism,the paper pointed out the risks and hidden dangers of the whole plot development including the land space planning system is not perfect,the"public welfare"review system is not sound,the supervision mechanism is not perfect,and the guarantee for the holder's participation right is insufficient.Based on local practice,the paper put forward relevant policy suggestions:using new development ideas to guide the development of the whole plot,improving the land and space planning system,standardizing the public welfare review system from the procedural perspective,strengthening post-supervision and public supervision,and improving the participation mechanism of land requisitioned people.
