摘　　要：研究分析小微企业面对美国337调查的困境及原因,发现小微企业调查前期应诉不足,应诉后多以基于和解和同意令从调查中撤出却无法达成有利局面,和解后缺乏长效机制。以皮卡车折叠盖调查案为例,通过宁波速派公司的应诉过程,总结提出了小微企业以规避设计为主、多种策略辅助的应对策略,以及基于高风险专利识别与分析的侵权防控及专利布局,以此形成调查后的长效机制。本文对于小微企业在未来对美出口贸易中遭遇337调查如何应对以及形成企业长期机制具有现实指导意义。Research and analysis are conducted on the difficulties and reasons faced by small and micro enterprises in responding to 337 investigations.Insufficient response in the early investigation,withdraw from the investigation based on settlement and consent orders without a favorable situation,a lack of long-term mechanisms after settlement are the main difficulties.Taking the 337 investigations of certain pick-up truck folding bed cover systems and components thereof as example,through the response process of Ningbo Supass Company,a variety of strategies primarily focused on avoiding design are summarized and proposed for small and micro enterprises as well as infringement prevention and patent layout based on high-risk patent identification and analysis to form a long-term mechanism after the investigation.It has practical guidance significance for small and micro enterprises to respond to the 337 investigations and form a long-term mechanism for enterprises in future export trade to the United States.
