摘 要:《行政处罚法》第24条授权省、自治区和直辖市将行政处罚权下移至乡镇人民政府和街道办事处,确立了“行政处罚权下移制度”。但是,该条款并没有明确乡镇人民政府和街道办事处享有下移的处罚权行使范围。从法治政府建设维度看,乡镇人民政府和街道办事处处罚权行使范围必须以其享有行政处罚主体资格为前提,并以授权方式确定。从规范价值看,乡镇人民政府和街道办事处处罚权行使范围确定了其行政执法主体资格,确认了乡镇人民政府和街道办事处的处罚权行使范围,确保了乡镇人民政府和街道办事处处罚权行使的规范化,有利于提高法治政府建设水平。The Article 24 of the Administrative Punishment Law establishes“the system of administrative punishment power moving down”.However,this clause does not specify the scope of the punishment power of the grassroots government.From the perspective of the construction of the government by law,the scope of the punishment power of the grassroots government must be based on the premise of the subject qualification of administrative punishment and determined in the way of authorization.From the standard value,the scope of the downward punishment power is beneficial to improve the level of the rule of law government construction,because it establishes the administrative subject status of the grassroots government,confirms the scope of the exercise of punishment power of grassroots government,ensures the standardization of the exercise of punishment power of grassroots government.
