“两法衔接”与行政违法行为检察监督融合研究

摘　　要：2023年7月,最高人民检察院统筹考虑“两法衔接”与行政违法行为监督对接的需要,将行政反向衔接工作调整为行政检察部门牵头负责,行刑反向衔接成为行政违法行为监督的主要线索来源。但在实践中,“两法衔接”较重视行政执法机关向司法机关移送涉嫌犯罪案件的正向衔接,对司法机关向行政执法机关移送行政处罚案件的反向衔接关注不够,虽然取得了一些重要进展,但在实践中存在诸多问题有待研究解决。应明确检察机关“两法衔接”与行政违法行为监督的工作原则,进一步完善相关规定,凝聚执法、司法监督合力,完善“两法衔接”信息共享平台,以推动行刑衔接和检察监督工作高质量发展。In July 2023,considering the need for the connection between the connection between administrative law enforcement and criminal justice and the supervision of administrative illegal acts,the Supreme People’s Procuratorate adjusted the administrative reverse connection work to be led by the administrative procuratorial department.The reverse connection between administrative and criminal justice has become the main source of clues for the supervision of administrative illegal acts.However,in practice,the connection between administrative law enforcement and criminal justice pays more attention to the positive connection of transferring suspected criminal cases from administrative law enforcement organs to judicial organs,and pays insufficient attention to the reverse connection of transferring administrative penalty cases from judicial organs to administrative law enforcement organs.Although some important progress has been made,there are still many problems in practice that need to be studied and solved.We should clarify the working principles of the connection between administrative law enforcement and criminal justice and the supervision of administrative illegal acts by procuratorial organs,further improve relevant regulations,gather the joint force of law enforcement and judicial supervision,and improve the information sharing platform for the connection between administrative law enforcement and criminal justice,so as to promote the high-quality development of the connection between administrative and criminal justice and procuratorial supervision.
