摘 要:侵犯著作权罪与销售侵权复制品罪的区分是刑事司法实践中长期存在的疑难问题。《刑法修正案(十一)》的出台在一定程度上解决了发行的“瘦身”问题,但两罪的关系依旧悬而未决。两高近期出台的《关于办理侵犯知识产权刑事案件适用法律若干问题的解释(征求意见稿)》试图再次解决这一难题,但依旧存在诸多不足之处。发行含义的界定不清导致两罪名的关系不明,引发司法实践中的适用混乱。民刑两大部门法的不同思维模式及概念体系的混用是导致这一问题的根本原因。传统理论存在方法论上的缺陷,应在法秩序统一的教义学立场上,以类型思维为工具,准确描述发行的类型,将两罪定位为法条竞合关系并从一重罪适用,同时杜绝数罪并罚的做法,体系性地消除适用冲突。The distinction between the offence of copyright infringement and the offence of selling infringing copies is a long-standing problem in criminal judicial practice.The introduction of Amendment(XI)to the Criminal Law has to some extent solved the“slimming”problem of distribution,but the relationship between the two offences is still unresolved.Recently,the Supreme People’s Court and the Supreme People’s Procuratorate issued the“Interpretation of Several Issues Concerning the Application of Law in Handling Criminal Cases of Infringement of Intellectual Property Rights(Draft for Opinion)”to try to solve this problem again,but there are still many deficiencies.The unclear definition of the meaning of distribution has led to the unclear relationship between the two offences,triggering confusion in the application of practice.The different modes of thinking and the mixing of conceptual systems of civil and criminal law are the root causes of this problem.The traditional theory has methodological defects,and should be based on the doctrinal position of the unity of the legal order,using the type thinking as a tool,accurately describing the type of distribution,locating the two offenses as a competing relationship of the law and applying them as a felony,avoiding the practice of multiple punishments,and eliminating the conflict of application in a systematic way.
