摘　　要：非法吸收公众存款罪既关注金融监管秩序中的金融准入秩序,也关注金融交易秩序,应综合考量其在纵向和横向维度上的规范目的。金融准入制度的目的在于保障金融交易秩序的良性发展,其间的关联可分化为如下两个层面的逻辑。其一,以金融准入制度为核心的“手段-目的等价型”层面,其重点在于规制和防止高风险的资本货币类运营的金融行为。其二,以金融交易制度为核心的“手段-目的离散型”层面,其重点在于保障交易信赖和交易秩序,落脚点为公众资金安全是否有被侵害的风险。在“手段-目的离散型”层面,判断标准为行为人是否充分、真实地发布了关键性信息,在被害人自我答责的场合应否定对犯罪的认定。此外,高回报率和高收益率不能作为入罪的判断标准。Illegal collection of personal savings deposits not only focuses on the financial access order in the financial supervision order,but also on the financial transaction order.Therefore,the vertical and horizontal dimensions of the normative purpose should be comprehensively considered.The purpose of the financial access system is to ensure the sound development of the financial transaction order,and the relationship between them can be divided into the following two levels of logic.On one hand,the“means⁃end equivalence”level with the financial access system as the core,and its focus is to regulate and prevent the financial behavior of high⁃risk capital and monetary operations.On the other hand,the“means⁃end discrete”level with the financial transaction system as the core,and its focus is to ensure the transaction trust and transaction order,and the foothold is whether the public fund security is at risk of being infringed.In the“means⁃end discrete”level,the judgment standard is whether the actor fully and truly releases the key information,and the identification of the crime should be denied in the case of the victims self⁃responsibility.In addition,the high rate of return and high rate of return can not be used as the judgment standard for the crime.
