摘　　要：农村生态环境治理不仅是生态文明建设的根本要求,也是乡村振兴战略的关键任务。村规民约作为非正式规范,蕴含民主自治、活法与软法等内容,在农村生态环境治理中发挥重要作用。其作为农村生态环境治理的重要手段和环境纠纷处理的重要依据,是传统文化与当代价值观念的显象载体。通过对F省X县93份村规民约调查分析发现,村规民约存在制定过程异化、文本形式同质化、环境规范支撑不足导致约束力弱化等问题。结合农村生态环境治理中村规民约的机理分析,村规民约的功能纠偏需加强自治、强化约束力。应结合“三治融合”实行规则优化,自治层面完善村规民约制定程序,法治层面软法与硬法有机结合,德治层面融合当地传统文化与当代价值观念;并通过内部优化村规民约环境规范内容,外部建立相关配套措施,健全村规民约实施体系。Rural ecological environment governance is not only a fundamental requirement of ecological civilization,but also a key task in the rural revitalization strategy.As an informal norm,village rules and regulations contain basic theories such as democratic autonomy,soft law and living law.Village rules and regulations also play an important role in rural ecological environment governance,which can be an important means of rural ecological environment governance and an important basis for environmental dispute settlement,and is a manifestation carrier of ideology and values.Through the investigation and analysis of 93 village rules and regulations in X county of F province,it is found that there are some problems such as mutation in the formulation process,homogenization of text form,and lack of support of environmental norms leading to lack of binding force.According to the mechanism analysis of village rules and regulations in rural ecological environment governance,the function correction of village rules and regulations needs to emphasize autonomy and strengthen its binding force,and the three governance integration can effectively deal with these difficulties.Therefore,the functions of village rules and regulations can be adjusted from the macro and micro levels.At the macro level,rules should be optimized in combination with the concept of three governance integration,improve the procedures for formulating village rules and regulations at the autonomy level,combine soft law with hard law at the level of rule of law,and the local traditional thoughts and contemporary values should be absorbed at the rule of virtue level.At the micro level,the implementation system of village rules and regulations is improved by optimizing the content of environmental norms of village rules and regulations internally and establishing relevant supporting measures externally.
