摘 要:“陆勇案”凸显了对药品犯罪认定的固有缺陷;新的《药品管理法》和《刑法修正案(十一)》对之虽有所改观,但也仍有新的问题须解决:新增设的妨害药品管理罪和修改后的生产、销售、提供假(劣)药罪,应明晰罪名所保护的法益,再对构成要件作实质解释;“假(劣)药”的概念内涵应在参照新《药品管理法》的基础上独立判断。“足以严重危害人体健康”既有限制妨害药品管理罪处罚范围之功能,又有连接生命健康和药品管理秩序法益之作用。确定药品犯罪的罪数,需厘清药品犯罪之间和药品犯罪之外这两类竞合关系。The inherent defects of drug crimes exposed by the"Lu Yong case"have been repaired by New Drug Administration Law and The Criminal Law Amendment(XI),but they have brought about new problems.With regard to the newly created crime of obstruct-ing drug administration and the amended crime of producing,selling and supplying counterfeit(substandard)drugs,the legal interests protected by the crime should be clarified,and then the constituent elements should be substantively interpreted.The concept of"coun-terfeit(substandard)drugs"should be judged independently with reference to New Drug Administration Law.The phrase"sufficient to seriously jeopardize human health"has the function of both limiting the scope of punishment for the crime of obstructing drug adminis-tration and connecting the legal interests of life and health and the order of drug administration.To determine the number of drug of-fenses,it is necessary to clarify the two types of competition and cooperation between drug offenses and outside drug offenses.
