“核心价值观条款”的规范配置及其优化——兼论社会主义核心价值观入法路径的完善

摘　　要：作为社会主义核心价值观显性入法的产物,“核心价值观条款”已经成为现行法上一种颇具中国特色的重要规范形态。“核心价值观条款”的规范配置问题是社会主义核心价值观显性入法的关键。科学的规范配置需要兼顾社会主义核心价值观的价值本质和不同类型规范的功能定位。现行法中的“核心价值观条款”在规范配置上虽采取了包括立法目的条款、国家目标条款、倡导性规范、义务性规范和说明性法条等多种规范类型,但其科学性仍有待进一步提升。对此,应在完善既有规范配置科学性的基础上,适当增加规范配置形态。受社会主义核心价值观的性质、法律规范的类型及表达形式等多重限制,以“核心价值观条款”为标志的显性入法存在入法深度和广度上的不足。将社会主义核心价值观作为法的价值基础融入法律内在价值体系的隐性入法可摆脱显性入法面临的限制,极大拓展社会主义核心价值观入法的深度和广度。未来应强化隐性入法与显性入法的结合,合力提升社会主义核心价值观入法的质量。As a product of the explicit incorporation of the core socialist values into law,“the core socialist values clauses”have permeated legal norms of various natures and hierarchies,becoming a distinctive normative feature within China’s legal system.The normative configuration of these clauses is a primary consideration in the explicit incorporation of the core socialist values into law,directly impacting the quality of this incorporation.Current laws feature several types of the core socialist values clauses,including legislative purpose clauses,national objective clauses,advocacy norms,obligatory norms,and explanatory provisions.The scientific nature of their normative configuration determines the quality of incorporation,requiring consideration of the value essence of the core socialist values,the functions of different types of legal norms,and the characteristics of the laws into which they are to be integrated.Regarding current normative configurations,national goal clause cannot be fulfilled without its binding force as a constitutional norm,therefore,the national goal clause is not suitable for application in departmental laws.The obligatory norm can be applied only in specialized legislation for specific groups but not in general legislation for all,as the requirement of socialist core values,the core socialist values cannot be universally transformed into legal obligations;thus,obligatory norms are only appropriate for specialized legislation targeting specific groups,not for general legislation.Advocacy norms align well with the moral and value essence of the core socialist values,leveraging their value declaration and behavioral guidance functions.However,overreliance on advocacy norms risks rendering the incorporation merely formal.Incorporating legislative purpose clauses is a Chinese legislative tradition.Using these as the core socialist values clauses can emphasize the core socialist values as legislative orientations,interpretative standards,interest-balancing metrics,and tools for addressing
