摘  要:过境安全关乎能源是否能持续稳定供应。在“一带一路”倡议下构建能源过境运输争端解决机制是保障能源安全过境、防范化解冲突,建立可持续能源安全合作框架的必然要求。通过借鉴《能源宪章条约》对过境运输争端机制的规定,以习近平总书记关于“人类命运共同体”理念为指导,在“一带一路”框架内厘清过境运输争端解决机制适用范围的基础上,提出争端解决机制适用的原则和在程序设计上应综合采取政治的方法和法律的方法;在机构设置上,以“一带一路”能源合作伙伴关系为依托成立争端解决机构,组建调解小组、仲裁庭和监督机构,对争端解决程序进行执行与监督,最后提出了现实可行并卓有成效的实现路径。Transit security is related to the sustainable and stable supply of energy.The construction of a dispute settlement mechanism for energy transit transport under the Belt and Road Initiative is an inevitable requirement for ensuring the safe transit of energy,preventing and resolving conflicts,and establishing a framework for sustainable energy security cooperation.By drawing on the provisions of the Energy Charter Treaty on the transit transport dispute mechanism,and guided by General Secretary Xi Jinping's concept of a"Community of Human Destiny",and on the basis of clarifying the scope of application of the transit transport dispute settlement mechanism within the framework of"Belt and Road Initiative",it proposes the principles of application of the dispute settlement mechanism and the adoption of political and legal methods in the design of the procedure;in terms of institutional setup,it establishes a dispute settlement body based on the'Belt and Road'Energy Partnership,and forms a mediation panel,an arbitration tribunal,and a supervisory body to carry out and supervise the implementation of the dispute settlement procedure,and finally it proposes a practical and effective implementation path.
