社会自我规制的理论反思与范式重构

摘　　要：在广义的规制概念体系中,社会自我规制是与行政规制相对应的规制概念。伴随着公共任务的不断增多,符合社会自我规制形态的治理举措也与日俱增,并以“合作治理”“参与治理”“社会自治”等形态存在于法治实践中。关于社会自我规制理论,无论是回应型法理论,或是反身法理论,还是后设规制理论,都存在着难以克服的内在局限。基于托马斯·库恩的范式理论,可以对社会自我规制从核心观念、规则结构和运行操作等方面进行理论重构。具言之,应当以优先、依法和有效的社会自我规制重构其理念范式,以实定法和规制法两类社会自我规制依据重构其规则范式,以目标、依据、对象、程序和结果等社会自我规制要素重构其操作范式等。反思和重构社会自我规制理论,有助于鉴别既有观点并形成理论共识,为推进新时代国家治理体系和治理能力现代化提供科学的理论范式。In the broad concept system of regulation,social self-regulation is the concept of regulation corresponding to administrative regulation.With the increasing number of public tasks,the governance measures in line with the form of social self-regulation are also increasing day by day,and exist in the practice of the rule of law in the form of"cooperative governance","participation in governance"and"social autonomy".With regard to the theory of social self-regulation,whether it is the theory of responsive law,or the theory of reflexive law,or the theory of post-regulation,there are inherent limitations that are difficult to overcome.Based on Thomas Kuhn's paradigm theory,social self-regulation can reconstruct its own theoretical paradigm from the core concept,rule structure and operation.In other words,it should reconstruct its conceptual paradigm with priority,legal and effective social self-regulation,reconstruct its rule paradigm on the basis of the two types of social self-regulation of real law and regulation law,and reconstruct its operational paradigm with social self-regulation elements such as objectives,basis,objects,procedures and results.Reflecting and reconstructing the social self-regulation theory is helpful to identify the existing viewpoints and form a theoretical consensus,which provides a scientific governance paradigm for promoting the modernization of national governance system and governance capacity in the new era.
