摘　　要：加快中国数字经济的发展,既要破解促进数字经济发展面临的瓶颈问题,又要化解与数字经济发展相伴相生的社会风险。为促进数字经济的发展,规制数据行为应成为法律体系建构的路径,具体来说,可从保护企业的数据权益、保障公平的竞争环境、促进数据资源的高效流转等方面构建法律制度,以加快数字经济的发展。此外,在法律风险的防范上,可从公、私法二分的规制路径展开。公法规制目标应设定为维护数字社会的公共秩序,保障国家的数字主权与人民的数字人权。私法规制应以保护私人权益为目标,可从树立场景化规制理念、构建可识别程度标准、规制算法技术滥用等方面展开具体的制度构建。To accelerate the development of China’s digital economy,we need to not only solve the bottleneckproblems faced in promoting the development of the digital economy,but also resolve the social risks thataccompany the development of the digital economy.To promote the development of the digital economy,regulating data behavior should become a path for the construction of a legal system.Specifically,legal systemcan be established from the aspects of protecting the data rights and interests of enterprises,ensuring a faircompetitive environment,and promoting the efficient flow of data resources to accelerate the development ofthe digital economy.In addition,the prevention of legal risks can be carried out through a dual regulatory pathof public and private law.The goal of public law regulation should be set to maintain public order in thedigital society,safeguard the digital sovereignty of the country and the digital human rights of the people.Private law regulation should be based on the logic of protecting private rights and interests,and specificinstitutional construction can be carried out from the establishment of scenario based regulatory concepts,theconstruction of identifiable standards,and the regulation of algorithmic and technological abuse.
