摘　　要：为解决新就业形态劳动者权益保障面临的新问题,我国开始构建新就业形态劳动者权益保障制度。根据新制度主义的渐进式制度变迁理论,我国新就业形态劳动者权益保障制度正在经历“叠加”式变迁,引进了许多新的规则。维护劳动者权益是工会存在的基础,也是其核心职责,在劳动者权益保障制度“叠加”式变迁过程中,作为制度变迁的主要推动者工会应当明确自身的角色和定位,介入制度的构建。研究建议,针对新就业形态劳动者权益保障制度构建在法律保障、职业保障、组织保障3个方面存在的问题,工会作为主要推动者应做到:通过源头参与积极推动新就业形态劳动者权益保障法治化体系的建立;直接推进新就业形态劳动者职业保障制度的完善;不断创新方式方法,扩大工会对新就业形态劳动者的覆盖范围并提升维权服务质量,确保新就业形态劳动者获得组织保障。To address the new issues faced in protecting the rights and interests of workers in new employment forms,China has begun to set up a rights protection system for them.According to the theory of incremental institutional change within new institutionalism,the labor rights protection system in China is undergoing"accumulative"changes,incorporating many new rules.Protecting workers'rights is the foundation of trade unions'existence and its core responsibility.In the process of"accumulative"changes in the rights protection system,the trade union should clarify its role and positioning,intervening as the main drivers of institutional construction.To address issues in legal,occupational,and organizational protections during setting-up rights protection system for workers in new employment forms,this study suggests that the trade unions,as the primary driving force,should actively promote the establishment of a legal framework for protecting rights of workers in new employment forms from the outset,directly advance the improvement of occupational protection system for them,continuously innovate methods to expand the union's coverage of workers in new employment forms and enhance the quality of rights protection services to ensure organizational support for them.
