兴奋剂违规处罚程序与仲裁程序的衔接研究

摘　　要：运用逻辑分析法、比较分析法等方法,深入探讨了我国在体育仲裁制度建立后,兴奋剂处罚程序与仲裁程序的衔接障碍,并提出了相应的衔接方案。研究发现,当前兴奋剂处罚权形式主体和实质主体的分离,使反兴奋剂中心可否成为兴奋剂仲裁案件的被告或共同被告存在问题,处罚单位在体育仲裁中的程序地位也不清晰,对于处罚单位可否在体育仲裁中指控反兴奋剂中心也存在疑问。研究认为,要理顺程序则有必要消解兴奋剂处罚权主体的分离现象,从长远来看,我国应顺应国际发展的大趋势,将处罚单位的权力完全让渡给反兴奋剂中心行使,但鉴于目前的法律障碍,可采取由处罚单位拥有处罚权,处罚委员会为其提供咨询建议,由反兴奋剂中心行使程序监督权的过渡方案。Through logical analysis and comparative analysis,the obstacles to the connection between doping punishment procedure and arbitration procedure were discussed after the establishment of the sports arbitration system in China.The corresponding connection scheme was proposed.It was found that the current separation of the formal and substantive subjects of doping violation rights made it problematic whether the China Anti-Doping Agency could be a defendant or co-defendant in a doping arbitration case,and the procedural status of the penalizing unit in sports arbitration was not clear.There were also doubts about whether the penalizing unit could sue the anti-doping center in sports arbitration.In the long run,China should follow the general trend of the international development and completely transferring the power of the punishment unit to the China Anti-Doping Agency.With regard to the current legal obstacles,a transitional plan could be adopted in which the punishment unit had the right to punish,the Punishment Committee provided advice,and the China Anti-Doping Agency exercised the right to supervise the procedure.
