马锡五审判方式及其对诉源治理的启示——以“封捧儿案”为切入点

摘　　要：马锡五审判方式是党在新民主主义时期法治建设的重要创造,注重调查、依靠群众、调判结合是其重要特征。“封捧儿案”是马锡五审判方式的典范案例,以诉源治理的视角对该案进行“麻雀式”剖析,可以帮助我们更好地探究马锡五审判方式的当代意义。马锡五审判方式与诉源治理同为党领导下的基层社会治理模式,同是能动履职理念驱动下的生动实践,同时,马锡五审判方式还是诉源治理产生的重要源头。马锡五审判方式启示我们在推进诉源治理工作时,一要紧紧依靠人民群众,树牢司法为民工作理念;二要坚持把非诉讼纠纷解决机制挺在前面,完善多元纠纷解决机制;三要立足司法审判职能,坚持实质化解矛盾纠纷。Ma Xiwu's trial mode is an important creation of the Party in the construction of the rule of law in the new democratic period,and its important characteristics are the emphasis on investigation,relying on the masses,and the combination of mediation and judgment.The Fengpenger Case is an exemplary case of Ma Xiwu's trial mode.Analyzing the case in a detailed and focused approach from the perspective of litigation source governance can help us better explore the contemporary significance of Ma Xiwu's trial mode.Ma Xiwu's trial mode and litigation source governance are both primary-level social governance models under the leadership of the Party,and they are both vivid practices driven by the concept of proactive performance of duties.Ma Xiwu's trial mode teaches us three lessons for promoting the governance of litigation sources:first,we must closely rely on the people and firmly establish the concept of justice for the people;second,we must put the non-litigation dispute resolution mechanism at the forefront and improve the diversified dispute resolution mechanisms;third,it we must resolve disputes in substance on the basis of judicial functions.
