新质生产力视域下我国专利链接制度优化方案研究

摘　　要：新质生产力是我国药品专利链接制度优化的时代面向。新质生产力的核心特征是科技创新,科技创新需要专利制度予以激励,但是我国既有专利链接制度未能完全适应新质生产力的发展要求,域外经验是我国药品专利链接制度优化的镜鉴。美国国内法首创构造完整的专利链接制度,并且通过《中美第一阶段经贸协定》和《全面与进步跨太平洋经济伙伴协定》向我国传播专利链接制度。聚焦创新是我国药品专利链接制度优化的宗旨:一方面,通过优化未披露试验数据保护等制度设计激励创新,另一方面通过优化专利挑战等制度设计激励持续创新。New quality productive force is the contemporary orientation in the optimization of China’s drug patent linkage system.The core feature of new quality productive force is scientific and technological innovation,which needs to be stimulated by the patent system.However,China’s existing patent link system does not completely conform to the development requirements of new quality productive forces.Relevant experiences from other countries function as a mirror and reference for the optimization of China’s drug patent linkage system.The domestic law of the United States pioneers a complete patent link system and spreads the patent link system to China through China-US Phase One Economic and Trade Agreement and Comprehensive and Progressive Trans-Pacific Economic Partnership Agreement.The chief purpose to optimize China’s drug patent link system evolves from its focus on innovation.On the one hand,the innovation stimulation is accomplished by optimizing the system design,with the unclosed trial data protection system being a case in point.On the other hand,a continuous innovation is stimulated by optimizing the system design,such as patent challenges.
