摘 要:发展新质生产力,建设我国数字金融强国,离不开数字金融监管。如何对创新特性数字金融进行有效监管,是世界各国共同面临的难题,也是对我国金融监管提出的重大挑战。本文基于数字金融监管的本土实践,借鉴域外有益的监管经验,在厘清数字金融监管法律逻辑的基础上,围绕构建全新的数字监管框架,针对我国数字金融监管存在的困境,提出构建系统重要性机构监管制度、革新传统的监管方式、搭建数字监管平台、完善细化“监管沙盒”制度与消费者保护法规等数字金融监管创新路径,促进数字金融创新,防范系统性金融风险。To develop new quality productive forces and build China into a powerhouse of digital finance cannot be separated from digital finance regulation.How to effectively regulate digital finance with innovative characteristics is a common problem faced by all countries in the world,and also a major challenge to China's financial regulation.This paper,based on the local practices of digital finance regulation and drawing on beneficial regulatory experience from abroad,clarifies the legal logic of digital finance regulation and,with the goal of building a brand-new digital regulatory framework,puts forward innovative paths for digital finance regulation to promote digital finance innovation and prevent systemic financial risks.In response to the dilemmas of digital finance regulation in China,these paths include establishing a systemically important institution regulatory system,reforming traditional regulatory methods,building a digital regulatory platform,and refining the regulatory sandbox system and consumer protection laws.
