摘 要:民国时期土地交易登记制度,经历了由传统社会中白契与中证确权,到登记对抗主义,再到登记生效主义的发展过程。其间受西方物权变动理论影响较大。基于历史发展和横向比较两个维度考量,民国时期土地交易登记制度存在维护交易安全和降低交易成本的矛盾张力。该制度最终的选择,表明其注重交易安全的价值理念。The land transaction registration system during the Republic of China period went through a development process from the traditional society of white deeds and certificate confirmation,to registration opposition,and then to registration effectiveness.The theory of property rights changes absorbed from the West during the modernization process of Chinese law has had a significant impact on this development process.From two dimensions of historical development and horizontal comparison,examining the land transaction registration system during the Republic of China period,it can be found that there was a contradictory tension between maintaining transaction security and reducing transaction costs in the land transaction registration system during this period.The ultimate choice of the land transaction registration system during the Republic of China period articulated that its core value was more focused on transaction security.
