摘　　要：检察意见作为中国特色社会主义法律监督体系中的重要组成部分,是检察机关依法行使检察职权的重要手段。检察意见具有一定的指导性和法律约束力,对实现法律监督和有效衔接执法活动发挥着关键作用,能够有效确保法律的正确实施、维护司法公正。但在理论和实践中,检察意见面临法律地位不明确、运行机制不完善、监督机制不健全等问题,导致其监督效能无法切实显化。以法律规范和司法实践为基础,在理论上明晰检察意见在我国法律体系中的角色,在制度中厘清检察意见在我国法律体系中面临的挑战,在策略上探索检察意见的前景,有助于促进检察意见的落实。通过立法或司法解释的方式,明确检察意见的法律地位,使其在法律体系中具有更加准确的角色和定位;完善运行机制,确保其使用过程的科学性和公正性;建立健全监督机制以提升检察意见的法律监督质效。Prosecutorial opinions,as an essential component of the legal supervision system under socialism with Chinese char⁃acteristics,are an important means for procuratorial organs to exercise their prosecutorial powers according to law.These opin⁃ions are characterized by their professionalism and legal binding force,playing a crucial role in the legal supervision of crimi⁃nal proceedings and related activities,as well as in effectively linking criminal proceedings with the activities of public securi⁃ty,procuratorial,judicial authorities,and administrative law enforcement.They can effectively ensure the correct implementa⁃tion of the law,uphold judicial fairness,and protect human rights.However,in theory and practice,prosecutorial opinions face issues such as unclear legal status,imperfect operational mechanisms,and incomplete supervisory mechanisms,which prevent their supervisory effectiveness from being fully realized.Based on legal norms and judicial practice,clarifying the special role of prosecutorial opinions in China's legal system in theory,identifying the challenges they face within the legal system,and explor⁃ing their potential prospects in strategy can help promote the accurate implementation of prosecutorial opinions.By legislative or judicial interpretation,the legal status of prosecutorial opinions can be clarified,giving them a more defined role and posi⁃tion within the legal system;the operational mechanism can be perfected to ensure the scientific and fair use of these opinions;and a robust supervisory mechanism can be established to enhance the quality and effectiveness of legal supervision through prosecutorial opinions.
