摘  要:从中资企业市场准入和平稳发展的角度出发,中资企业雇佣“一带一路”项目建设地员工有其必要性。但“人是社会人、情感人、文化人,人的属性是社会性的,人是有社会文化需求的。”[1]145不同文化的碰撞必然导致冲突。根据霍夫斯坦德对文化结构形式的四种分类理论,在“一带一路”投资中,招聘和管理海外劳工不可避免地会遭遇来自于物质文化、制度文化、行为文化和心态文化四个方面的文化掣肘。西方国家的联合制裁和抹黑,部分国家现代化社会的法治能力和意识的欠缺,民族多元性以及“一带一路”沿线各国复杂多样的宗教文化是造成掣肘的主要原因。应从国际法、国内法和公司内部规章制度三个方面来防范和应对中资企业在海外劳工过程中遭遇的文化掣肘。以期在有法可依的前提下采用事前防范、事中协调和事后止损的全程管理方式来舒缓海外投资的文化风险。From the perspective of market access and stable development of Chinese-funded enterprises,it is necessary for Chinese-funded enterprises to hire employees from the construction site of the"Belt and Road"project.However,people are social people,emotional people and cultural people.People's attributes are social,and people have social and cultural needs.The collision of different cultures will inevitably lead to conflict.According to Hofstede's four classification theories of cultural structure,in the"Belt and Road"investment,the recruitment and management of overseas workers will inevitably encounter cultural constraints from four aspects:material culture,institutional culture,behavioral culture and mentality culture.The joint sanctions and smears of Western countries,the lack of legal capacity and awareness of modern societies in some countries,the diversity of ethnic groups,and the complex and diverse religious cultures of countries along the"Belt and Road"are the main reasons for the constraints.We should prevent and deal with the cultural constraints encountered by Chinese enterprises in the process of overseas labor from three aspects:international law,domestic law and internal rules and regulations.In order to alleviate the cultural risks of overseas investment,we should adopt the whole process management mode of prevention in advance,coordination in the event and stop loss afterwards on the premise of law.
