高校职务科技成果赋权制度优化问题研究

摘　　要：【目的】找出国内高校职务科技成果赋权制度存在的问题,以及由此产生的科技成果转化的阻碍因素,提高高校职务科技成果转化率。【方法】通过梳理美国、德国、日本等国家关于职务科技成果转化的规定,再根据国内部分高校的政策规定,找到我国高校赋权改革试点政策中的问题。【结果】指出高校赋权改革试点政策中存在程序过于烦琐、赋权改革客体范围过于笼统、成果转化困难、定价责任豁免规定模糊等现状。【结论】提出创新权属划分方式、专利价值分类评估、革新责任承担方式、明确定价过失豁免标准等改进建议。[Purposes]This paper aims to find out the problems existing in the empowerment system of job-related scientific and technological achievements in domestic colleges and universities,as well as the obstacles to the transformation of scientific and technological achievements,and improve the conversion rate of scientific and technological achievements in colleges and universities.[Methods]Through sorting out the regulations of the United States,Germany,Japan and other countries on the transformation of job-related scientific and technological achievements,and then according to the policies and regulations of some domestic universities,the problems in the pilot policies of empowerment reform in Chinese universities are found.[Findings]It is pointed out that there are some problems in the pilot policy of empowerment reform in universities,such as too complicated procedure,too general scope of the object of empowerment reform,difficult transformation of results,and vague exemption of pricing responsibility.[Conclusions]Finally,some suggestions are put forward,such as innovating the way of ownership division,patent value classification evaluation,innovating the way of liability undertaking,and clarifying the exemption standard of pricing negligence.
